Terms
and Conditions
These
general sales conditions apply to all jobs carried out by Anna
Bowman Translations Ltd for its clients and should be read in
conjunction with our quality control policies.
1)
If, after reviewing our quotation, you wish to proceed to hiring
our services, you may be forwarded an agreement, which includes
the price and details as established by both parties. This purchase
agreement must be signed and returned to us by either regular
mail, e-mail or fax. We reserve the right to refuse to start a
job without a signed agreement. Email confirmation may be sufficient
to proceed and in anticipation of this all correspondence may
be retained for reference purposes.
2)
Technical documents should be accompanied by reference material
(if available) supplied by the client. Plus any drawing or diagrams
which would help to gain a better understanding of the original
documents.
3)
Translations shall be counted by word in the source language,
unless otherwise previously established in writing.
4)
In the event that a client cancels an order, all work already
completed shall be billed at 100%, work which is suspended shall
be billed at 50%.
5)
Unless by an account holder, or otherwise specified, all invoices
must be paid in advance of work starting, or on completion of
work prior to delivery, depending on specific terms negotiated.
6)
Any late payment or failure to pay shall be cause for immediate
collection of the entire amount due from the client, without previous
notice or other formalities. Anna Bowman Translations Ltd reserves
the right to request interest calculated according to the official
rate of the Bank of England in effect as of the date that such
payment becomes overdue. Moreover, the client must reimburse any
expenses English to Russian Translation Services incurs to settle
the case.
7)
All orders in progress shall be suspended in the event of late
payment.
8)
Complaints shall be taken into consideration if received within
five days of delivery of the jobs or part of them. All complaints
must be accompanied by the original documents and disputed translations.
Once the above time period has elapsed, the translation shall
be considered correct. Our liability shall be limited to the Pound
Sterling amount of the invoice.
9)
In the event of an unsatisfied client, thus in the case of a complaint
within the established deadlines, Anna Bowman Translations Ltd
agrees, at its own expense, to deliver an edited version of the
disputed translation within a timeframe equal to one third of
the original timeframe, plus 24 hours. This second document shall
be used to judge the quality of the translation in order to establish
the amount of reimbursement.
10)
Anna Bowman Translations Ltd shall not be held liable for any
delays caused by malfunctioning faxes, modems, e-mail and other
mail or carriers, not directly controlled by Anna Bowman Translations
Ltd.
11)
In the event of late deliveries for more than one third of the
established time, and in the event that the delay is directly
and solely attributable to Anna Bowman Translations Ltd, a reimbursement
shall be paid, to be established between the parties, up to an
amount of 100% of the job delivered late.
12)
Defects present in one part of the translation shall not be grounds,
for any reason whatsoever, for questioning the entire translation.
We reserve the right to make modifications in such cases.
13)
Only written agreements between the parties shall be taken into
consideration. British Law shall have jurisdiction for all disputes.
In the event of failure to pay, all representation and partial
or total reproduction of such translation shall be illegal. Copyright
shall be held by Anna Bowman Translations Ltd on all translated
documents. Title to copyright shall only be transfered after full
payment is made. Anna Bowman Translations Ltd reserves the right
to request a client who uses unpaid material for immediate payment
of the translation and compensation for copyright where applicable.
Translation
Payment Options
Cheque
This
is the preferred method of paying for translation services. Cheques
are acceptable from any UK bank when issued in Pounds Sterling.
Credit/Debit
Card
For
a long time we were unable to offer credit card processing, but
thanks to some recent change, we elected to use PayPal as a third
party payment processor. We do this for a number of reasons: it
is safe and highly secure with no information held or stored by
us in any way. This protects you as well as protecting us. Please
click on their logo below. Furthermore, PayPal no longer require
you to sign up before paying for services, so the combination
of these factors allows us to keep payments lower than would be
necessary when setting up a bespoke credit card payment system.
Bank/Wire
Transfer
International
bank transfers, and BACS transfers, are safe and secure ways to
send money. Payment can be sent to our bank in the UK. The beneficiary
account information will be forwarded to you should you select
this option.
Cash
Payment
We
like to offer a full range of payment options. Therefore a 'paying
by cash' facility is available for pickup and delivery of sensitive
or lengthy documents. However, we do not recommend sending cash
through the post.
Liability
Anna
Bowman Translations Ltd and/or related suppliers do not acknowledge
any guarantee or condition related to services offered, including
all implicit guarantees and conditions regarding salability, suitability
for a particular purpose, ownership and non violation of the rights
of others.
Anna
Bowman Translations Ltd and/or related suppliers shall not be
liable, for any reason whatsoever, for special, indirect or consequential
damages or for any other damages of any type resulting from the
loss of rights to use, loss of information or lost profits, whether
they result from performance of the contract, negligence or other
detrimental actions, deriving from or in some way connected with
the services of Anna Bowman Translations Ltd.
